5. Cryptocurrency Risk Disclosure

Cryptocurrency investments carry significant risks, including:

8. Exchange API Connections

When connecting exchanges:

• You must only provide read-only API keys , never keys with trading or withdrawal permissions
• You are responsible for the API keys you provide and their security settings
• You should revoke API keys immediately if you suspect compromise
• We are not responsible for losses resulting from improperly configured API keys

9. Acceptable Use

You agree not to:

• Use the Platform for any illegal purpose or in violation of applicable law
• Attempt to circumvent security measures or gain unauthorized access
• Scrape, harvest, or systematically download platform data
• Use automated bots or tools to access the Platform at abnormal rates
• Upload malicious code, spam, or harmful content
• Impersonate SmartViewAI, our team, or other users
• Use the Platform to manipulate markets or disseminate false information

Violation of these terms may result in immediate account suspension or termination.

10. Subscriptions and Payments

• Subscription fees are charged in advance and are non-refundable unless required by law.
• You may cancel your subscription at any time; access continues until the end of the billing period.
• We reserve the right to change prices with reasonable notice.
• Failed payments may result in suspension of paid features.
• Lifetime subscriptions grant access to all current and future Premium features for the lifetime of the Platform.

11. Intellectual Property

All content on SmartViewAI, including the software, design, algorithms, AI models, course content, and branding, is owned by SmartViewAI and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.

By submitting content to the Platform (e.g., community posts), you grant us a non-exclusive, worldwide license to display and use that content on the Platform.

12. Third-Party Services

Our Platform integrates with third-party services including exchanges, data providers, and payment processors. We are not responsible for the accuracy, availability, or actions of these third parties. Your use of third-party services is subject to their own terms and privacy policies.

Affiliate links on our platform may earn us a commission. This does not affect the services or pricing you receive from those third parties.

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTVIEWAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR INVESTMENTS, ARISING FROM YOUR USE OF THE PLATFORM.

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless SmartViewAI, its officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

16. Termination

You may delete your account at any time from your account settings. Upon termination, your right to use the Platform ceases immediately.

These Terms are governed by the laws of the United Arab Emirates (UAE), without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
